问一下物管费的事情

近日到新居(还没有入住,正在装修)看了看,发现有两张单子贴在大门处,一张是<物管费催交单>,需于7月15日前到服务中心交纳上半年物管费500余元;另一张是<水表抄表通知单>,每吨水价是2.24元.对此本人有点疑问,请教原住民:1、在当时领取房间钥匙的时候，本人记的发过一张银行卡，里面应该是有钱的；2、与物管处联系，未入住的交纳物管费为70%，说是有规定的，是不是这样？3、上半年的物管费是怎么算出来的，今日一报纸报道一社区的物管费只有收取每月0.2元，而且还有2至多万元的利润；4、小高层的水价是不是比多层贵，本人记得多层只要1.85元/吨;5、难道村民对这些都没有意见吗，这些都是合理的吗？？

到目前为止小区有多少邻里交过物管费了,最近收到催交单大限为七月十五日止,不知大家如何处之,其实并非是不交物管费,主要是对物业目前的工作现状有些看法而已.我想大家一定也有同感吧.

告诉一下楼上的新邻居：1、银行卡要托收水费之类的，需要到银行办理托收手续；2、小高层和高层的水是要经过二次加压的，因此还要加上加压用的电费，所以收取的水费中除了真正的水费外，还有电费；3、只要你银行卡里有足够的钱（当时办卡时，可能只存入了几百元吧），物管费应该可以从卡上扣除的。

告诉新来的居友,政苑小区的物管还是不错的,而且我们小区的物管费是算比较便宜的.你还是及时交掉物管费为好.前几天,静江家园的大家物业因收不抵支,撤离了小区,造成小区一团糟.[em03]

<table cellspacing="0" cellpadding="0" width="100%" border="0"><tbody><tr><td class="le_ht14black" align="center" height="40">转昨天《都市快报》报道一篇作假物管遇到较真业主 2007-07-13 陈栋</td></tr><tr><td height="10"></td></tr><tr><td class="le_15black"><div id="ozoom" style="ZOOM: 100%;"><table cellspacing="0" cellpadding="0" align="left" border="0"><tbody><tr><td><table cellspacing="0" cellpadding="0" width="300" border="0" style="BORDER-RIGHT: #999 1px solid; BORDER-TOP: #999 1px solid; MARGIN: 0px 8px 8px 0px; BORDER-LEFT: #999 1px solid; BORDER-BOTTOM: #999 1px solid;"><tbody><tr><td align="center"><img height="210" src="http://hzdaily.hangzhou.com.cn/dskb/images/2007-07/13/118425341777121475662912912397.jpg" width="300" border="0" alt=""/></td></tr><tr id="enp_pic_detail_tr"><td class="px12" align="left" bgcolor="#e0e0c9" style="PADDING-RIGHT: 3px; PADDING-LEFT: 8px; PADDING-BOTTOM: 3px; LINE-HEIGHT: 18px; PADDING-TOP: 6px;"><div id="enp_pic_detail"> </div></td></tr></tbody></table><table cellspacing="0" cellpadding="0" width="300" border="0" style="BORDER-RIGHT: #999 1px solid; BORDER-TOP: #999 1px solid; MARGIN: 0px 8px 8px 0px; BORDER-LEFT: #999 1px solid; BORDER-BOTTOM: #999 1px solid;"><tbody><tr><td align="center"><img height="197" src="http://hzdaily.hangzhou.com.cn/dskb/images/2007-07/13/11842534177716261925209074917.jpg" width="300" border="0" alt=""/></td></tr><tr id="enp_pic_detail_tr"><td class="px12" align="left" bgcolor="#e0e0c9" style="PADDING-RIGHT: 3px; PADDING-LEFT: 8px; PADDING-BOTTOM: 3px; LINE-HEIGHT: 18px; PADDING-TOP: 6px;"><div id="enp_pic_detail">　　两张同一编号的发票，内容、金额相去甚远，备注中的水表状态成了“水管爆裂抢修”。</div></td></tr></tbody></table></td></tr></tbody></table>　　作假物管遇到较真业主 　　历时半年查出物管费窟窿　　记者陈栋　　　　本报讯不久前，本报曾报道过《你知道你的小区每年有十几万元的额外收入吗》（2007年6月15日），小区物业收入的去向引起了许多业主的强烈关注。杭州城西一家小区的业主委员会专门做了一次“独头”（杭州俚语，指做事固执的人），经过半年多的调查，弄清楚了该小区物业公司的具体财务数据。几天前，业委会代表周先生专门来到快报，向记者讲述了小区业委会调查的来龙去脉。　　业委会历时半年调查物业收入　　事情起因于去年下半年，因在小区物业收入上与物管公司有不同意见，业委会要求物业公司进行财务公示。拿到物业公司一份附有发票的财务收支报表后，一叠财务发票副本让业委会发现了破绽。　　“一共36张发票复印件，31张与原件不符，不仔细看不出毛病。”小区业主周晓传（化名）是业委会成员，他花了最多的时间、精力进行调查。其间，他拿着财务报表到税务局、自来水公司等部门进行了多次查询，结果让人意外：许多发票都被人改过。　　比如同一张编号为NO.1947607的地税发票，原件的缴税金额为3600元，复印件上却成了12828元，多出了9228元；编号为No.00084546的自来水总公司发票，原件内容是用水总量，物业公司提供的同一张内容却变成了水管爆裂抢修，金额为2000元，而从发票的日期看，那段时间小区内并未发生过水管爆裂。　　周晓传向记者出示了这些发票，在原件复印件的对比下，可以发现，许多发票的条款、金额都明显被涂改。　　除了发票的问题，细心的业委会在一项外来商贩小区设摊管理费上也发现了问题。物业公司提交的财务报告说，2005年8个月内共取得此类收入1400元。但在接下来的日子，业委会派专人每天进行实地调查登记，在经营环境和收费标准不变的情况下，同样是8个月，此类收入实际为6750元，两个数字差距很大。　　“小区收废品的要交年费，我们这个小区收废品的只有一个人，一年要交2800元。”该小区一位业主告诉记者，“但物业公司交给收废品者一张收据，没有发票。”　　小区业委会表示，小区业主聘请物业公司，是为小区业主做好服务，小区物业收入也本该取之于民、用之于民。虽然物业公司需要有经营收入维持正常开支，但弄虚作假来给小区业主一个交代显然缺乏诚信。　　对业主的反映，该小区物业公司胡经理坦言曾在发票管理上出过问题。“物业公司在这件事上也算交了学费。”他解释说，“当时那位财务人员业务不熟，因此出了差错，日前公司重新配备了财务人员，今后工作上的差错要改进。”　　物业公司虚报身份　　经过这件事，物业公司的另一个问题也暴露了出来。　　根据建设部《物业管理企业资质管理办法》规定，物业公司分为一级、二级、三级等三个资质等级和临时资质，必须取得相应的资质才能上岗执业，各级资质对注册资金、管理人员资质、管理的小区类型和面积等都有明确的规定。　　在周晓传居住的小区，物业公司办公室悬挂有资质证书。“资质证书上说是二级企业，但到2004年9月到期，可它还一直挂着。”由于之前的财务报告有虚假成分，业委会对公司资质也产生了怀疑。6月15日，业委会向杭州市房管局递交了一份咨询报告。管理部门很快给予了答复：该物业公司为三级资质企业。　　资质搞清楚了，新的问题又来了。　　按照法定条件，“三级企业物业管理专业以及工程、管理、维修等相关专业类的专职管理和技术人员不少于10人，其中中级职称以上的不少于5人，物业管理专业人员中应有8人按照国家有关规定执有职业资格证书”。业委会做了专门的调查后发现，该公司2006年11月办理的国家三级资质年检中，10份专职人员资质证书中不少专职人员早已离开这家公司，还有几位甚至从来没在该公司任职过。　　业委会决定召开大会，就是否更换物业公司进行商议。目前，杭州市房管局已受理此事。杭州市房管局物业监管处有关人士表示，将会同西湖区建设局对此事进行调查，如查证属实，将依照建设部125号令依法处理。　　这个小区的经历值得其他业主借鉴　　为了和物业公司较真，周晓传说自己已经成了物业专家。　　“最近半年我学了许多法律知识、政策文件，朋友开玩笑说，我现在可以去上物业课了。”在与物业公司打交道的过程中，周晓传总结出了几点：第一、找社区进行调解，打官司是费时费力的事情，一般小区业主很难坚持下来；第二、对不诚信的物业公司，一定要找主管部门，对管理部门要有足够的信任；第三、和不负责任的物业公司打交道，掌握客观详尽的证据很有必要，在维权中会取得主动。　　浙江六和律师事务所刘成林律师表示，业主委员会到职能部门进行账务等相关咨询，是行使监督权的一部分，业主委员会只要能证明与查询事宜有关，并且履行相应的程序手续，管理部门应予以配合。事实上，在周晓传受业委会委托去各部门查询相关材料时，确实得到了很大的支持。　　“很多问题是长期积累下来的，也许一时半刻无法完全解决，但一定要有人开这个头，任何事情都是逐步完善起来的。”周晓传认为，以前业主们总是被动等待，正好让滑头公司钻了空子，其实主动去做些证据的搜集，会比较妥善和快速地促进问题的解决。　　在目前物业服务整体水平不高的情况下，小区业主如果能掌握较多的法律常识，不但可以维护自己的权益，还有可能促进物业管理行业的提升。　　业主、物管互相信任是长期共处的基础　　杭州一些品牌物业公司曾做过内部测算，一般情况下，目前杭州的新建小区规模在8万平方米以上的通过正常物业收入基本可以保本，10万平方米以上的可以赢利。那些规模较小的小区就得依靠一些经营性收入弥补物管开支，另外，诸如房屋、水电维修等开发商遗留下来的问题也会直接影响后期物管的赢利与否。　　业主和物业公司在经营理念上存在差异，有争议很正常，如何减少双方纠纷的发生？　　滨江物业一位负责人认为，现在很多物业公司往往采用管的办法，导致一些业主产生抵触心理，其实应该提供服务，与业主经常沟通，建立融洽的关系，比如业主论坛就是一个比较好的沟通途径，而一些业主也要提高素质，动不动拒交物业费的做法，反而会影响双方的信任度，不利于问题的解决。　　如果小区全体业主确实认为物业公司服务不到位，2006年10月1日实行的《浙江省物业管理条例》规定提到“第二十九条一个物业管理区域由一个物业服务企业提供物业服务。提倡业主通过公开、公平、公正的市场竞争机制选择物业服务企业” ，更换物业公司是全体业主的权利。　　曾在戴德梁行就职的物管人士王煦说，国外品牌物业管理机构在处理此类问题上，会很严谨地走法律程序，即使小到物业管理费，如果有业主在三次催促之下还拒绝缴纳的，将会收到律师函，最终通过法律途径进行解决，而在国内，基本上没有物业公司可以做到这样。“虽然与大环境有关，但是这一定会是今后的趋势，未来的物业管理必然要走向市场化。”</div></td></tr></tbody></table>
