物管公司告上法庭》，报道了某小区<personname wst="on" productid="王">王</personname>女士因邻居野蛮装修，而要求物管公司进行干涉，但物管公司消极不作为，<personname wst="on" productid="王">王</personname>女士气愤之下，拒交物管费，而被后者告上法庭。作者在咨询相关法律人士情况下，认为交纳物<personname wst="on" productid="管费是王">管费是王</personname>女士合同义务，<personname wst="on" productid="王">王</personname>女士必须交纳，否则承担败诉的不利后果，并但出如下结论：“对于业主来说，交物业管理费就是花钱买服务，那么如果服务质量有问题，可以不交物管费吗？在许多时候，业主们认为这是一件天经地义的事情，既然服务不到位，当然可以不付钱，然而，一些法律界人士却告诫，这看上去很“合理”的事情却并不合法。” 同样作为一个法律工作者，我认为<personname wst="on" productid="王">王</personname>女士还是有胜诉希望的。她咨询的律师或都戴和平主任的观点值得商催。 <personname wst="on" productid="王">王</personname>女士与物业公司签订物业合同是实，且其确有交纳物管费的责任，但物业公司也有义务按照物管合同进行物业管理的义务，这是双方对等给付的责任。如本文中物业合同规定物管有责任对邻居的野蛮装修有管理责任，且其在事实上没有进行必要管理，<personname wst="on" productid="王">王</personname>女士当然可以以此做为抗辩理由，拒绝交纳物管费。笔者的这一观点，也是得到《民事裁判标准规范》（人民法院出版社2005年版，作者均系全国各级法院法官，此书出版目的就是为了确立一个较为统一的民商事案件的裁判标准。在此书中，就提到因为物管公司提供的服务质量达不到合同约定致使业主拒绝交费的，则属于物业违约在先，业主拒交是依法采取的自我救济手段，在这种情况下，受诉法院可以根据物来提供的质量状况，判决驳回物业的诉讼请求或者减少业主的物管费用。以上只是我一方观点，如有不同意见或法律上的咨询请来邮:lawyeryoung@163.com

等到交了第一笔物管费后，就联合本单元业主起诉物管破坏公共设施、疏于管理，服务合同履行不到位，应当承担返还部分物管费和破坏设施的修复责任。

中国人是好弄的，机关工作的人更有组织纪律性的，并没有多少民主的主张意识。所谓各人自扫门前雪，莫管他人瓦上霜。

有一点需要提醒大家，拓宽1号路的真正目的，不是为业主服务！也不是业主提出的要求！更不是为游泳池服务！而是为即将投入使用的菜场上面的综合楼提供足够的车位。
